Phonegate Alert denounces a new lack of transparency on the dangers of mobile phones and connected objects. Out of 62 test reports of non-compliance with the Specific Absorption Rate (SAR), 30 remain untraceable in the DATA database of the National Frequency Agency (ANFR). Our NGO has therefore just written to Gilles Brégant, its director general, to ask for its communication.

Dozens of reports missing despite our reminders

The facts of our research are precise:

  • 8 models do not display any link to their report,
  • 3 send to “NOT FOUND” pages,
  • 19 do not give access to the announced report.

Despite numerous reminders and arrests in the press, nearly one report out of two of the mobile phones with health risks remains inaccessible to the public, for some since the inspection carried out in 2017. Among them is the iPhone 12, whose non-compliance report has been absent since 2021.

A serious breach of ANFR’s legal obligations

These reports are administrative documents that can be communicated. Article L. 300-2 of the Code of Relations between the Public and the Administration (CRPA) and several opinions of the CADA Commission for Access to Administrative Documents (including 20164447) have unambiguously confirmed this.

By refusing to communicate this data, ANFR is voluntarily depriving citizens, journalists and consumers of information essential for their health and safety.

Between 2012 and 2018, ANFR hid hundreds of test reports

” From 2016 to 2018, my legal action as a Phonegate whistleblower forced ANFR to publish hundreds of SAR test reports kept secret since 2012 by France. Today, history is repeating itself. The Agency is still trying to hide the truth and our NGO will not hesitate, once again, to go to court to obtain these documents. The health of users comes before the interests of manufacturers. »

Our demand for transparency

Phonegate Alert demands the immediate communication of the 30 missing reports, including that of the iPhone 12, and the firm commitment of the ANFR to make all control data accessible, without restriction. Without rapid progress, we will take all necessary legal measures to enforce the law and protect public health.
